Busted by the cops in California for growingI

Not sure what forum to put this in, my neighbor has a grow room in his basement, I built it, own and installed all of the lights, 3 months ago he refused to give me my lights back and today the cops came by and raided his basement growroom,

I believe that he had 8 mature plants plus some dried weed, he told the cops it is all my operation, both of us have medicann cards, the cops ran mine to see if it was real, they asked me if I ever grew/watered any plants down there, I told them I grew 5 small plants earlier this year for my doctor approved serious medical condition.

The cop got a bit mean, asked to search my vehicle, I said no, he asked why, I told him that you guys asked me to come to the station to finish filing a assault report against my neighbor with the underrground grow room.

They gave me the field sobriety test and threatened to arrest me for DUI/Marijuana. They took my car keys and said I can have them back tomorrow becuase I appeared in coherent from my newly aquired head concussion, they cop from yesterday told the detective to give me my keys, I should be ok, They also gave me harsh warnings about driving under the influence of pot, don't do it.!

They asked me why I use medical pot, for my cancer condition and arthritis, they wanted to know where I keep my pot and how much I currently have. I told them that I have a small amount at home, not realizing while at the police station I had a pipe in one shirt pocket and part of a baggie hanging out of the other pocket, they didn't seem to notice.

What I am wondering, I own the lighting equipment, offered to let me neighbor grow and share between us, I have never sold pot ever, Do you guys think I should retain a lawyer?

Follow up:

Cops went to where I use to live, I lived i small house, owner lives in big house where the grow room is/was located and confiscated all the lighting and grow equipment, while they did this, they hand cuffed the dude, then when they left, they let him go.

I believe this guy had 5 fully mature plants drying, 3 or 4 plants budding in the grow room and lots of cuttings from trimming buds.

From everything I have read, I should have no problem, he borrowed grow lights, used them and ran over the 6 plant limit!

Since he wasnt arrested, what might be next?

I believe this is way too small for the feds to even be called in which means 215 and 420 card holders should be in the clear, other than the dude would not give me back my grow lights, he originally told the cops he owns them, so they are his, but now he has changed his story saying they are mine.

Sounds like we don't have all the facts but if there are no charges filled there should be no need for a lawyer. I would consider moving and cut your loses as far as getting lights back etc. Sounds like your neighbor is the main concern,

The cops know the lights were mine, 3 months earlier he told me that I should considerr the equipment as part of the rent, and I say that because when I went there to get my property he told them that they are his. Later that day I was questioned, I own the lights, he had me put the lights in his basement because my house only has 10Amp service, barely enough to run the house.

After they verified my Medicann CArd, they told me that it isn't illegal to own the equipment, one cop saw me loading, tomato plants, cayenne pepper plants and other garden plants, then he told me that those lights are legal and can be used for growing vegetables.

I am not sure what got taken from ,my neighbors basement other than the lights, and I am guessing 5 to 8 mature plants,

I have been sm0king pot for 35 years and don't intend to stop now, I have never sold any, can't seem to grow enough at one time to last to the next grow cycle. Ihave already moved, he bashed my head in last week and I have severe brain concussion, two seperate police reports were taken and submitted to the D.A. for review. As far as the grow room, I believe that they are submitting paperwork to the DA for review. I followed 215 and 420 laws by growing less than 6 plants about 3 tall, harvested them around April this year, after that I was never allowed to go in my neighbors house, the cops say he said the entire operation is mine, however, in his locked basement!

Wow, it sounds like the lights may be the least of your problems. Having received a severe blow to the head you are lucky to be alive.

I wouldn't count on much help from the cops in getting your lights back, since they were not in your possesion when they were taken.

A MMP in Visalia CA was busted for growing not too long ago. They released him with no charges. He had to get his lawyer involved to get his lights back. More legal wrangling a week later got his weed back. It seems to me some police departments have their own interpetation of the law.

You may be able to find inexpensive lights on the internet. This will be cheaper than getting a lawyer, and less hassle than filing a civil suit.

After being interview by the count sheriffs and the questions that they asked makes me believe that my neighbor with the underground grow room got caught with more plants than Medicann allows one person, and they asked me if I was trimming or anything else to do with what they found in his locked basement.

When the cops questioned me, they played, good cop, bad cop, and asshole cop.

Funny thing, when I went to my house with the sheriffs they helped me get all my stuff that was still there except the grow lights, the grow lights and some mature plants, trimmins and othere stuff were in the main house locked basement.

Looks like the sheriff wants to get this guy for growing with intent to sell!

I can't help that this guy borrowed my lights and wouldn't give them back!

This is an interesting subject because most small county law enforcement do not know much about the state of california medical marijuana laws.

One thing that happens every day is that someone driving a motor vehicle gets a Marijuana DUI.

This all happened on County Property, even though we are just a few miles from the National Forest, we were not on federal land.
